Azerbaijan’s Cabinet of Ministers has approved the "Rules for confirmation of compliance of agreements with competition legislation."
Report informs that Prime Minister Ali Asadov has signed a decision in this regard.
These rules have been prepared in accordance with the Competition Code and regulate the application and decision process for determining whether agreements comply with competition legislation.
Any party to an agreement can voluntarily submit a written application to the competition authority for the exclusion of the concluded agreement. When a case is initiated regarding the subject of the agreement, the parties to the agreement can apply within 30 days after notification. If the application does not meet the requirements of clause 2.2 of the rules, the petition is accepted by decision of the competition commission.
The application must include information such as the parties to the agreement and their legal addresses, the subject matter of the agreement, its nature, technical and economic characteristics, duration, and geographical area of application.
According to the rules, the evaluation of applications is completed within 30 days. In special cases, the review period can be extended by an additional 30 days. Applicants are notified of this within 5 working days.
As a result of the application evaluation, the competition authority or commission makes a final decision on whether to exclude or not exclude the agreement. The decision remains in force as long as the accepted conditions are met.
