Ban on e-cigarettes approved in Azerbaijan

Azerbaijan has prohibited the import, export, production, storage, wholesale and retail sale, and use of electronic cigarettes and their components.

According to Report, President Ilham Aliyev approved the relevant amendments to the Law "On Tobacco and Tobacco Products."

Under the law, electronic cigarettes containing nicotine are now classified as tobacco products.

An electronic cigarette is defined as a product intended to deliver vapor-with or without nicotine-into a person's body through the respiratory tract, using a device with a mouthpiece or other components, including a cartridge and bottle, either together or separately. The bottles can be used once or multiple times, or refilled with disposable cartridges.

The law clarifies that heated tobacco products will not be considered electronic cigarettes.

A heated tobacco product is defined as a product made from tobacco (or a tobacco blend) and non-tobacco components, designed to deliver nicotine-containing aerosol into the human body through the respiratory tract by heating without combustion and without producing tobacco smoke.

The clarification of definitions is intended to allow more precise classification and differentiation of tobacco products, including heated tobacco products and electronic cigarettes, in legal practice.

The law will take effect on April 1, 2026.
