According to the 2015 European Court of Human Rights decision in the case of "Chiragov and others v. Armenia", IDPs who were recognized as victims visited their native Lachin district, Report informs.
During the visit, the IDPs were accompanied by the Deputy Chairman of the Supreme Court of Azerbaijan, Chingiz Asgarov.
IDPs from Chiragli, Kamalli, and Aghbulag villages of the district - Akif Hasanov, Adishirin Chiragov, Fakhraddin Pashayev, Elkhan Chiragov, and Sagatel Chiragov visited their native homes, more precisely, the remains of their homes.
Residents said they felt immense joy returning to their native land after 30 years of longing for the Motherland.
According to the decision of the European Convention on Human Rights adopted on June 16, 2015, on the claims of Azerbaijani citizens Elkhan Chiragov, Adishirin Chiragov, Ramiz Jabrayilov, Akif Hasanov, Fakhreddin Pashayev, and Garaja Jabrayilov dated April 6, 2005, articles 8, 13 and 14 of the "European Convention on the Protection of Human Rights and Fundamental Freedoms" and Article 1 of Protocol No. 1 on the Convention were violated. However, despite the fact that more than seven years have passed since the adoption of the decision, Armenia does not fulfill the obligations imposed on it, six people known as victims do not pay compensation for the moral and material damage caused to the citizens of Azerbaijan. Also, according to the decision, although the responsible state should create a special mechanism for the restoration of the rights of Azerbaijani refugees and internally displaced persons, this issue was not implemented by Armenia.
The decision of the European Court of Human Rights on this leading case, which is of a precedent character, is the first and, so far, the only document of the international judicial body recognizing the violation of the property rights of Azerbaijani IDPs in the occupied territories and confirming the fact of occupation.
