Constitutional Court upheld citizen's appeal on apartment

Baku. 8 July. REPORT.AZ/ Next open hearing of Plenum of the Constitutional Court of Azerbaijan Republic has been held.

Report informs, in the hearing presided by Farhad Abdullayev, constitutional case regarding verification of conformity of the decision of Supreme Court Civil Board dated June 25, 2015 to the Constitution and laws of Azerbaijan Republic has been considered under citizen Movsum Mammadov's appeal.

Plenum of the Constitutional Court heard report of the judge S.Hasanova, speeches of the applicant and representatives of the respondent body, adopted a decision, investigating and discussing case materials.

The decision declares that the decision of Supreme Court Civil Board dated June 25, 2015 on the civil case regarding Rahib Mammadov's claim to consider null and void of the apartment's purchase contract signed betwen 'Əzizbəy-KM' Limited Liability Company and M.Mammadov as well as eviction from apartment, to be considered invalid as it doesn't complies with Part I of Article 29 of the Constitution of the Republic of Azerbaijan, Part I of Article 60 and Articles 416-cı, 417.1.3-cü and 418.1 of Civil Procedure Code.

Case will be reheard in order and date defined by the civil procedural law.
