Payment on compulsory insurance  to be carried out due to the new rule in Azerbaijan

Baku. 16 January. REPORT.AZ/ Amendments to the law On compulsory insurance would clarify some uncertainties regarding the mandatory car insurance.This uncertainty is dealt with 3-4% of all insurance claims. Report informs it was stated by the chairman of Azerbaijan Insurers Association (AIA) Orhan Bayramov. According to him, in obedience to the amendment, if both sides are guilty of committing an accident, each of them will be paid only 50% of the sum insured.

O. Bayramov noted that currently for the police only three principles exist, so the degree of fault of each is determined by half. According to him, changes related to the degree of fault are not expected.Currently used three principles: the driver is guilty, not guilty and both drivers are guilty.There only 3-4% of the total cases that pays 50% of the sum insured.The latest amendment is intended to clarify this uncertainty.This does not apply to other cases.

AIA Chairman noted that the principle applied in many countries of the world will enhance the responsibility of drivers.If both drivers are guilty, the insurance company will indemnify partially.
